Welcome to Apex Covers! The terms “we”, “us” and “our” refer to Apex Covers. Apex Covers operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Apex Covers is powered by Shopify, which enables us to provide the Services to you. These Terms of Service (the “Terms”) describe your rights and responsibilities when you use our Services. Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services.

2. Product Information and Customization

Each Apex Custom Cover is made to order based on your vehicle’s year, make, model, and trim. Product images and renderings on our site are for illustrative purposes only; actual colors, textures, and patterns may vary depending on your device and material choice. We reserve the right to modify or discontinue any product at any time without notice.

3. Custom Production Process

All seat covers are handcrafted to order. The process typically includes:

• Processing Phase (24-48 Hours): We collect required vehicle details before production begins.

• Production Phase (2–4 Weeks): Covers are cut, stitched, and quality-checked.

• Shipping Phase (7–10 Business Days): Once complete, your order is shipped with tracking provided. 

Production timelines may vary based on demand and material availability.

Customers may be required to provide vehicle interior photos or additional information to confirm seat configuration, fitment accuracy, or installation concerns. Failure or refusal to provide requested information may limit available remedies, delay production or resolution, or result in denial of a return, exchange, or refund.

4. Warranty Terms

All Apex Custom Covers are backed by a one-year limited warranty that covers manufacturing defects in materials or workmanship, including issues such as stitching failures, strap defects, or hardware malfunctions under normal use.

5. Orders, Cancellations, and Modifications

Orders are confirmed once payment is processed. Because each product is made to order, cancellations or modifications must be requested within 24 hours of purchase. After that, materials and production scheduling begin, and cancellations are no longer possible. Please review your order carefully before submission. 6. Refunds and Returns

Our products are built to order and custom-fit for each vehicle year, make, model. Due to this personalized process, returns are limited. Please refer to our Refunds & Returns Policy for details regarding eligibility, restocking fees, and warranty coverage.

Due to the custom-made nature of our products, Apex Covers may, at its discretion, offer repair, adjustment, replacement, or exchange as a first remedy prior to issuing any refund. Refunds are not guaranteed and are issued only after review and approval in accordance with our Refunds & Returns Policy.

7. Shipping and Delivery

Production and shipping times are estimates and may vary. Once an order has shipped, tracking details will be emailed to you. Apex Custom Covers is not responsible for delays caused by carriers, customs, or circumstances beyond our control. Ownership and risk of loss transfer to the customer once the package is accepted by the shipping carrier. Carrier tracking confirmation or delivery scan constitutes proof of delivery, and delayed tracking updates or carrier processing issues do not invalidate shipment completion.

8. Limited Warranty Claims

To submit a warranty claim, email hello@apexcustomcovers.com with your order number, clear photos of the issue, and a brief description. Approved claims may result in repair, replacement, or partial refund. Claims are reviewed within 5–7 business days.

9. Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction and that any minors using the Services do so with your consent. You are responsible for maintaining account security and accuracy of information provided. You may not transfer or assign your account to others.

You are responsible for ensuring that all information provided, including vehicle year, make, model, trim, and configuration details, is accurate and complete at the time of purchase.

10. Product Representations

We make every effort to ensure accurate product representation. However, colors and product appearances may vary due to display differences. We do not warrant that any product or service will meet your expectations. All descriptions are subject to change without notice.

Proper installation of seat covers is the responsibility of the customer. Fitment issues resulting from improper installation, failure to follow provided instructions, or failure to cooperate with installation guidance do not constitute manufacturing defects.

11. Orders and Acceptance

Placing an order constitutes an offer to purchase. Apex Covers reserves the right to accept or decline orders at its discretion. Orders are not accepted until confirmed by us. Purchases are for personal use only and subject to our Refund Policy.

12. Prices and Billing

Prices, promotions, and discounts are subject to change without notice. The price charged will be the one in effect at the time of order confirmation. Prices exclude taxes, shipping, and handling unless otherwise stated. You agree to provide accurate and complete billing and payment information.

13. Shipping and Delivery Liability

We are not liable for shipping delays or delivery issues caused by carriers or external events. Once the order is handed to the carrier, risk and ownership transfer to you.

14. Intellectual Property

All content, design, and materials on our website are the intellectual property of Apex Covers or its licensors. You may use our Services for personal, non-commercial use only. Unauthorized use may violate intellectual property laws.

15. Optional Tools

You may be granted access to third-party tools provided “as is” and “as available.” We are not responsible for their use, performance, or reliability. Your use of such tools is entirely at your own risk.

The Services may contain links to third-party websites. We are not responsible for the content or accuracy of such sites. Accessing third-party websites is at your own risk, and any issues should be directed to the third party.

17. Relationship with Shopify

Apex Covers is powered by Shopify, but all transactions occur directly between you and Apex Covers. Shopify is not responsible for sales, customer service, or damages arising from transactions with us.

Your personal information is governed by our Privacy Policy, available on our website. Because our Services are hosted by Shopify, your information may also be processed by Shopify and third-party partners as necessary.

19. Feedback

Apex Covers reserves the right to refuse service, limit remedies, cancel orders, or suspend accounts in cases of fraud, abuse, excessive disputes, repeated chargebacks, harassment of staff, or other bad-faith conduct.

22. Termination

We may terminate or suspend access to our Services at any time without notice. You remain responsible for any outstanding obligations. Certain sections, including Intellectual Property and Limitation of Liability, survive termination.

23. Disclaimer of Warranties

The Services and all products are provided “as is” and “as available.” We make no representations or warranties regarding accuracy, reliability, or suitability for any purpose. Your use of our Services is at your sole risk.

You agree to indemnify and hold harmless Apex Covers, Shopify, and affiliates from any claims arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

Failure to enforce any part of these Terms does not constitute a waiver. These Terms, along with our posted policies, form the entire agreement between you and Apex Covers.

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict of law principles.
